We will inform you of any changes we make to these Terms and Conditions and may ask you to accept them again. Access to this Site by unregistered customers constitutes acceptance of the risk that the information on this Site may be altered or removed.
Terms and Conditions for Online Customers
These Terms and Conditions (the "T&C"), together with your order, if you purchase a Product, and other documents referred to in the T&C, form an agreement between Oriflame Cosméticos, Lda, a company registered in the Commercial Registry of Sintra with NIPC 501 955 615 ("Oriflame", "we") and you ("you", the "Customer").

The T&Cs set out the legal terms and conditions governing your use of this Oriflame sales platform https://pt.oriflame.com (the "Site") to purchase products.
These T&C, the Oriflame Privacy Policy (the "Privacy Policy") and any other terms and policies incorporated herein by reference (collectively the "Policies") constitute the entire agreement.These T&C, the Oriflame Privacy Policy (the "Privacy Policy") and any other terms and policies incorporated herein by reference (collectively the "Policies") constitute the entire agreement between you and Oriflame with respect to the subject matter of the agreement and supersede all other prior agreements, understandings, negotiations and discussions, whether oral or in writing.
1. ELIGIBILITY
1.1. You represent and warrant that you are eighteen years of age or older, or if you are under eighteen years of age, you are accessing the Site with the knowledge and consent of your legal guardian.
1.2. The Customer also affirms and warrants that they are fully able and competent to fulfil the terms, conditions, obligations, affirmations and guarantees set out in these T&C and that they will comply with them.
1.3. The Customer affirms and warrants that they can make payments by credit card or other payment method permitted by the Site.
2. YOUR ACCOUNT
If you register with us through the Site ("Registered Customer"), you are responsible for choosing a secure password, which must contain at least 6 characters, for maintaining the confidentiality of your account and password, and for restricting access to your computer or device, and you agree that you accept responsibility for all activities that occur while using your account or password. Oriflame reserves the right to refuse to provide a service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.
3. PRODUCTS
The "Oriflame Products" or "Products" are the cosmetics and accessories, as well as certain food supplements, offered for sale under the Oriflame Trade Mark are defined. All Products, prices, offers and promotions are valid and binding during the period indicated on the cover of our catalogue (the "Catalogue" and the "Catalogue Period"). The Catalogue is identical to the Catalogue used by us in offline sales during the relevant Catalogue Period. The Catalogue describes the main characteristics of the Products.
4. PLACING AN ORDER
4.1. The Customer can place orders from the Catalogue by selecting the Products they wish to purchase.
4.2. Once selected, the Products will be added to your shopping basket. You can review and modify the contents of the shopping basket at any time, by changing the quantity of Products, deleting Products or removing the entire contents of the shopping basket.
4.3. You can place orders at any time of the day, except during a limited period of unavailability during the closing of the Catalogue, when we update the Catalogue.
4.4. An order is considered to have been placed when the following steps have been completed:
4.4.1. you have selected the Products you wish to purchase, using the "add to basket" option;
4.4.2. has selected a delivery option (if there is more than one option);
4.4.3. has explicitly accepted these T&C and the Oriflame Privacy Policy;
4.4.4. has provided the personal data required for delivery and has accepted that we may manage this data in the ways explicitly stated and for the purposes explicitly stated; and
4.4.5. has selected a payment method.
4.5 Once you have placed your order online, confirmed it and your payment has been accepted, an order confirmation email will be sent, at which point the purchase contract will come into force. We will refund any payment you have made if the order is not properly fulfilled. In addition to the order confirmation, you will receive a list of your Products. The list provides a summary of the Products sent to you. It also contains important information about your rights.
4.6. Orders that have been finalised and paid for cannot be cancelled, except for rights of return and/or withdrawal where applicable - see clauses 8 and 9.
4.7. Not all Products may be available at all times. If a Product is out of stock when you are placing your order, we will make reasonable efforts to inform you before your order is finalised so that you can change or cancel your order.
4.8. The Catalogue may, from time to time and for limited periods of time, be unavailable due to maintenance or technical reasons. Oriflame is not responsible for such failures and will reject any claims from Customers or other visitors.
5. PRICES AND PAYMENT
5.1. Unless otherwise stated, the prices of the Products shown in the Catalogue represent the selling price for the Products at the time the order is placed. All prices are indicated in local currency and include VAT at the legal rate in force.
5.2. Oriflame reserves the right to change prices at any time.
5.3. Prices do not include transport costs, delivery and any other fees and expenses which are clearly indicated as being additional to the price, during the ordering process and which may vary depending on the delivery method and/or other option chosen by you.
5.4. If the Customer has a discount coupon and activates it by submitting their code as indicated on the Site, we will deduct the amount from the price.
5.5. Payments can be made, among other payment methods, by credit card. Most payment cards are accepted. Normally, is only charged to your credit card when your order is ready to be dispatched. If, exceptionally, your credit card is charged before your order is dispatched, you will still be entitled to a refund under the terms of clause 9.

5.7. To guarantee the security of online credit card payments, all payment information will be encrypted. This means that all data will be sent over a secure connection. Since Oriflame collaborates with authorised payment service providers, credit card information is handled appropriately and in accordance with the Payment Card Industry's International Data Security Standards.
6. DELIVERY AND RISK TRANSFER
6.1 The Products ordered can only be delivered within the national territory.
6.2 Delivery will be made to the address you have given us, unless otherwise agreed.
6.3 We will process and deliver your order as quickly as possible, but no later than within thirty (30) days.
6.4 Oriflame cannot be held responsible for non-delivery, incorrect or delayed delivery caused by you providing incorrect or incomplete data.
6.5 Oriflame reserves the right to reject, whenever necessary, an order placed by you, in the event of justified doubts as to the possibility of the correct fulfilment of the order.

7. CONFORMITY OF OUR PRODUCTS
We guarantee that Oriflame Products are manufactured in accordance with the Guidelines for Good Manufacturing Practice for cosmetic products EN ISO 22716:2007 and the Oriflame Code of Practice.
8. ORIFLAME GUARANTEE
8.1 We strictly adhere to the rules on the return of Products applicable in Portugal. Please see clause 9 for more details.
8.2 We also guarantee the quality of any product bearing the Oriflame name and make sure that products manufactured by us or for us meet the highest quality standards. We are confident that our customers will be satisfied with our products. However, if for any reason you are not completely satisfied with a product purchased from Oriflame, you may exchange it or request a full refund (excluding delivery charges) within thirty (30) days of receiving the product. This guarantee does not apply to products damaged intentionally or through misuse. Please note that this guarantee is in addition to your statutory rights, including the rights under clause 9, which are not affected by it.
8.3 You can return or exchange a product by contacting our Customer Service using the details above.
8.4 Products may be damaged in transit, so please check their condition on delivery. To help us identify damage and quickly correct errors, please ensure that you, or the authorised recipient of the delivery, describe the damage/defect on the delivery documents upon return.
9. RETURN AND REFUND RIGHTS
9.1 You may cancel an order for Products, without giving any reason, during the period set out in clause 9.2. This means that during the relevant period, if you change your mind or for any other reason decide that you do not want a Product, you may notify us of your decision to cancel the order and receive a refund.
9.2. Without prejudice to what is expressly provided more favourably for you herein, you may cancel an order at any time after you have received order confirmation by email or after your order has been verbally confirmed.You may cancel an order at any time after your order has been verbally accepted by Customer Service, but only within 14 working days from the day that you physically received the Products or the last of the Products ordered, if there is more than one shipment.
9.3 To cancel an order, please contact our Customer Service (details above). You can use the free resolution form to notify us of your cancellation. If you complete this form online and submit it via our website, we will send you a confirmation of receipt of the cancellation on a durable medium (e.g. by email) without delay. You can choose to keep a copy of your cancellation notice for your own records. You only need to exercise your right to cancel before the cancellation period expires. So, if you send us your cancellation notice by email or post, then your cancellation is effective from the date your email or letter is sent to us. If you contact us by phone to notify us of your cancellation, then your cancellation will be effective from the date of your phone call.
9.4 You will receive a full refund of the amount you paid for the Products and any applicable delivery charges (except for additional charges resulting from your choice of delivery type other than the lowest value standard delivery type provided by us). We may make deductions from your refund for loss of value of any Products supplied, in the event that the loss is the result of mishandling on your part. You will only be liable for the loss of value of the Product(s) arising from improper handling to determine the nature, characteristics and functioning of the Product(s).
9.5. We will process the refund as soon as possible and, in any event, within (a) fourteen (14) calendar days from the day on which we receive the Products returned by you, or (b) (if earlier) 14 calendar days from the day on which you provide proof that you have returned the Products or (c) the day on which you provide proof that you have returned the Products.(c) if the Products have not been delivered, 14 calendar days from the day on which you notified us of the cancellation as described in clause 9.3, subject to clause 9.8. If you have returned the Products to us because they are damaged or incorrectly described, please see clause 9.6.
9.6 If you have returned the Products to us under clause 9 because they are damaged or incorrectly described, we will refund the full amount paid for the defective Products, any applicable shipping charges, and any reasonable costs you incur in returning the items.
9.7 We will refund to the credit card, debit card or other means of payment used, unless otherwise agreed; in any event, you will not incur any fees resulting from the refund.
9.8 If the Products have been delivered to you:
9.8.1. You must return the Products to us without undue delay and no later than 14 days after the date of cancellation of the order/contract. The deadline is met if you return the Products before the 14-day period has expired.
9.8.2 Unless the Products are damaged, or not as described (in which case see clause 9.6), you will be responsible for the direct costs that arise from returning the Products to Oriflame;
9.8.3 You are obliged to keep the Products in your possession and ensure their good condition while in your possession.
9.9 Details of your legal right to cancel and an explanation of how to exercise that right, including the cancellation form, will be provided in the product list, as described in clause 4.5.
9.10. Oriflame is obliged to supply the Product(s) in accordance with the contract. You will always have legal rights in relation to Products that are damaged or do not correspond to their description. These legal rights are not affected by the returns policy in these T&C.
10. PERSONAL DATA AND PRIVACY
10.1 If you provide information on the Site, you agree to provide, whenever requested, correct, current and complete information about yourself and you agree to update this information(the "Personal Data"). We will use and maintain the Personal Data we collect on the Site in accordance with applicable law and the Oriflame Privacy Policy
Oriflame is the entity responsible for the processing of Personal Data and is therefore responsible for ensuring that your Personal Data is processed in accordance with legislation in force. Further information on the need for and use of your Personal Data can be found in our Privacy Policy.
10.2 When we provide Personal Data to subcontractors, we only provide the Personal Data necessary for them to perform their services. All subcontractors are explicitly prohibited from using Personal Data for purposes other than those mentioned above, and from sharing any Personal Data with any other than us or as permitted by law.
10.3 If you give your consent to the disclosure and use of your data for marketing purposes, we will also provide your Personal Data to the Beauty Advisor (see clause 11.2), chosen by you or assigned by us, so that the Beauty Advisor can use your Personal Data to inform you about new Products, services, events and promotions. If you authorise, such Personal Data may also include details of your orders.
10.4 You have the right to review, update or correct your Personal Data by logging into your account and updating the details, or by sending an email to our Customer Service . We may need to contact you in order to verify that the order was placed by you or someone authorised by you.
10.5 You may at any time refuse to receive commercial information from us or a Beauty Advisor; such refusal should be sent to the email address indicated in the relevant commercial information sent by us or the Advisor.
10.6 Cookies are the name of a technology that allows our Site to store information on your browser. They provide the browser with a recognisable identifier only by our Site while you are browsing it, without identifying you. You can read more about our Cookies Policy in the Oriflame Privacy Policy. You can also send any queries regarding your personal data and privacy protection to our Customer Service.
11. OPTIONS FOR REGISTERED CUSTOMERS
11.1 To improve the efficiency of the ordering process, we offer you the option of registering on the Site. Once registered, we will store your Personal Data and use it automatically for future orders.
11.2. We suggest that you connect with an Oriflame Brand Partner (formerly a "Beauty Advisor"), who will advise you on Products, their use and features, help you with the ordering process and answer any questions you may have about us, our Products and promotions.
11.3 Please note that Brand Partners are not employees, agents or representatives of Oriflame and are not authorised in any way to act on our behalf. Brand Partners are independent persons who co-operate with us and are familiar with our Products and promotions. Brand Partners are bound by the strict rules of conduct and ethics in our Code of Conduct. We encourage you to inform our Customer Service of any unfair, aggressive or inappropriate behaviour by a Brand Partner.
12. TRADEMARKS AND COPYRIGHT
12.1 Oriflame, our logo and the names of the Products or ranges of Products produced, marketed, sold or distributed by us are distinctive signs owned by the Oriflame Group. All other trademarks, trade names and logos used on the Site are the trademarks, trade names or logos of their respective owners who may or may not be affiliated with, connected to, or sponsored by Oriflame. Any use and/or copying of any marks on the Site requires prior authorisation from their respective owner.
12.2. All content included on, or made available through, the Site including, but not limited to, software or digital code, scripts, text, artwork, photographs, graphics, logos, button icons, still or moving images, videos, audio and compilations, may be used as a convenience to Oriflame.and data compilations (the "Content") are the property of Oriflame, its Content suppliers or any other owners who may or may not be affiliated with, connected to, or sponsored by Oriflame. Content that does not belong to us has been duly licensed to us by these owners and is protected from unauthorised use, copying and dissemination by copyright, trademark, publicity and other laws through international treaties.
12.3 Unless expressly authorised in writing by us, you must not capture, reproduce, perform, transfer, sell, license, modify or create derivative works of or based on all or any part of the Content, republish, reverse engineer, upload, edit, post, transmit, display advertising, frame, link to, distribute, or otherwise take advantage of all or any part of the Content. Nothing contained in these T&Cs or on the Site should be construed as granting, by implication or otherwise, any licence or right to use any Content without prior written permission from us or the third party owner of the Content or intellectual property on the Site.
12.4 The Catalogue is protected by copyright. Reproduction, copying, sale, resale or marketing of the Catalogue is strictly prohibited.
12.5 Any use of the Content other than as permitted in these T&Cs constitutes a breach of the T&Cs and may constitute copyright and/or design right infringement and/or patent infringement. You agree not to use the Content for any unlawful purpose and not to infringe our rights or the rights of others. You agree not to interfere (or permit any third party to use your registration in order to interfere) with any third party's normal processes for using the Site, including without limitation by attempting to administrative access to areas of the Site.
13. TERMINATION; MODIFICATION
13.1 We may verify and determine your breach of these T&C at any time at our sole discretion. Any breach of the T&Cs may result in restrictions on your access to the Site or any part of it.
13.2. If we do not insist that you fulfil all of your obligations under these T&Cs, or if we do not enforce our rights against you, or if we are late in doing so, this does not mean that we will be liable to you. this does not mean that we have waived our rights against you and it will not mean that you do not have to fulfil these obligations. If we waive breaches carried out by you, we will only do so in writing, and this will not mean that we will automatically waive any other breaches carried out by you.
13.3 We reserve the right to modify or discontinue this Site or any of its parts without notifying you or any third party.
14. ERRORS AND CORRECTIONS
Whilst we endeavour to include correct and current information on the Site, we do not warrant or represent that the Site is error-free. Data entry errors or other technical problems may sometimes result in incorrect information being published. Oriflame reserves the right to correct any inaccuracies or typographical errors on our Site, including errors in pricing, product availability and services, and shall not be liable for any such errors. We may also make improvements and/or changes to the Site's features, functionality, or content at any time. If you see any information or description that you believe to be incorrect, please contact Customer Service.

We may provide links to external sites and sources. Our provision of such links does not constitute sponsorship of the information, Products or services obtained through such links. We are not responsible for the content or performance of parts of the Internet, including other sites to which the Site may be linked or which may be accessed from the Site. You must inform us of any errors or inappropriate materials found on the sites to which this Site is or may be linked.

16. HANDLING OF COMPLAINTS AND DISPUTES

If you are not satisfied with the response from Oriflame Customer Service, you can contact the Portuguese Institute of Direct Selling here or the European Direct Selling Association (Seldia) here.
Without prejudice to our mutual right to submit any questions relating in any way to the use of our Site or the Products you have purchased to Oriflame we will do our best to resolve such disputes through amicable negotiation and mitigation, rather than through the courts. Please address your questions and complaints to our Customer Service in the first instance.

17. LAW AND JURISDICTION IN FORCE
If you reside in Portugal, please note that these T&C are governed by the laws of Portugal. This represents a contract for the purchase of the Products through our Site, and any dispute or claim arising out of or in connection with such purchase shall be governed by the laws of the Territory. You and Oriflame agree that the courts of the Territory shall have exclusive jurisdiction. If the laws of the Territory are not applicable, Swiss law shall apply.
18. MISCELLANEOUS
18.1 Oriflame is not responsible for blocking, through administrators, email servers from transmitting messages/notifications to your email address or for removing or blocking emails through software installed on your computer.
18.2 Your order, the applicable T&Cs, which may be recorded or printed, including any document referred to in them, shall form part of the contract between you and us.
18.3 The contract can only be concluded in Portuguese and not in other languages.
19. Oriflame strictly adheres to the Seldia Code of Conduct(http://www.seldia.eu/sites/default/files/uploads/content-pdf/seldia_codeofconduct.pdf) and the World Federation of Direct Selling Associations (WFDSA)(http://www.wfdsa.org/files/world-codes/code-book.pdf). Oriflame requires its Advisors to strictly adhere to these codes as implemented in the Oriflame Code of Ethics and Rules of Conduct. You can also obtain copies of these documents from Customer Service at email clientes@oriflame.com.
19.1 We may transfer our rights and obligations under a contract to another organisation, however this will not affect your rights or our obligations under these T&C.
19.2 You may only transfer your rights or obligations under these T&Cs to another person if we authorise you to do so in writing. However, if you have purchased a Product to give away, you may transfer the benefit of our guarantee in clause 8.2 to the recipient of the gift without needing to seek our authorisation.
19.3 Each contract is between you and Oriflame. No other person shall have any rights to enforce any of its terms. However, the recipient of your gift (Product) will benefit from our guarantee in clause 8.2. We will not need your authorisation to cancel or make any changes to these T&C.
19.4 Each of the clauses in these T&C operates separately. If any court or relevant authority decides that any of them is unlawful or unenforceable, the remaining clauses will remain in full force and effect.
19.5 Oriflame's failure to enforce any of the provisions contained herein shall not be deemed a waiver of their validity.
19.6 Oriflame reserves the right to update and amend these T&C. Any amendments or updates shall become effective upon posting on our website https://pt.oriflame.com for new customers.
19.7 Any changes will be deemed accepted if you continue to order Products after the changes have been implemented and you have been notified of them.
19.8 Unless you do not accept, we may send you alerts, notifications, email, post and communicate with you. You can update your preferences for marketing communications sent by us at any time by logging into your user settings. By accepting these T&Cs, you agree to Oriflame sending you any other information/ communications regarding your orders by durable means other than paper (i.e. via email or any other means sent personally to you, which allows you to store the information in an accessible form for your future reference, over a long period of time, and which allows you to store the information in an accessible form for your future reference, over a long period of time.(i.e. via email or any other means sent to you personally, which allows you to store the information in an accessible form for your future reference over a long period of time, and which also allows you to reproduce such information exactly, since Oriflame will not archive a copy to make available to you in the future).
19.9 The notification period under these T&Cs shall commence on the date on which the notification is sent by registered post. If the notification is delivered by other means, the notification period shall begin on the day of receipt of the notification. This does not apply to situations where you inform us of returns under clause 9 - the period for returns starts from the date on which you inform us that you wish to return the Product.
